This website is administered by MIGENIX Inc. The primary purpose of migenix.com is to provide information about MIGENIX Inc. We want you to feel secure when visiting our site and are committed to maintaining your privacy when doing so. Your privacy is important to us. Any personal information provided to us is collected, used and disclosed in accordance with the Personal Information Protection Act (PIPA) or other applicable legislation.

The following provides an overview of how we protect your privacy during your visit to our web site.

WHAT IS PERSONAL INFORMATION?
“Personal information” is information about an identifiable individual, but does not include contact information or work product information.

“Contact information” is information that enables an individual to be contacted at a place of business, including their name, title, business telephone number, business address, business e-mail or business fax number.

WHAT INFORMATION DO WE GATHER?
Information on migenix.com may be gathered in two ways: (1) indirectly (for example, through our site's technology); and (2) directly (for example, when you provide Personal Information on various pages of migenix.com).

We collect information indirectly from you through our Internet access logs. When you access migenix.com, your Internet Protocol (IP) address is automatically collected and is placed in our Internet access logs. This is a unique number that identifies the personal computer from which you access our site, but which does not personally identify you.

The MIGENIX website may, on occasion, use a technology called 'cookies'. A cookie is a token that a server gives to your browser when you access a website. Cookies are capable of storing many types of data and help provide additional functionality to the site or to help us analyze site usage more accurately. In all cases in which cookies are used, we will not collect personally identifiable information except with your explicit permission.

We collect Personal Information directly from you when you voluntarily submit it to us. For example, through our web site, we may provide the opportunity to submit a resume, register for receipt of news about the company, or inquire about business development opportunities at MIGENIX. It is completely up to you whether or not you want to provide your personal information, therefore, by providing us with your personal information you are providing your consent for us to use it in the way you request it to be used. You have the right to request that your personal information be withdrawn from our records, with reasonable notice.

HOW DO WE USE THE INFORMATION WE COLLECT INDIRECTLY?
We use information collected by this site for the following purposes: we analyze it to determine what is most effective about our site, to help us identify ways to improve it, and eventually, to determine how we can tailor migenix.com to make it more effective. We may also use data for other purposes, which we would describe to you at the point we collect the information.

HOW DO WE USE THE INFORMATION WE COLLECT DIRECTLY?
If you provide personal information while registering for receipt of news about the company, or inquiring about business development opportunities at MIGENIX, this information will only be used for the purpose you provide it to MIGENIX Inc. for. If MIGENIX Inc. wanted to use your personal information for a purpose other than what you have voluntarily supplied it for, then MIGENIX Inc. would obtain your consent before proceeding with this alternate use. If you do not provide your consent, or if you withdraw your consent, your personal information will not be used.

WHAT YOU SHOULD KNOW IF YOU ARE SENDING YOUR RESUME TO MIGENIX INC.
The hiring process at MIGENIX Inc. typically involves a panel comprised of a number of employees who review resumes, determine which candidates should be interviewed, conduct interviews, review credentials and participate in reference checks.

Resumes will be reviewed for any suitable opening even if the opening is not the one a candidate applied for. However, if the candidate is requested for an interview for a different position from the one the candidate applied for, the candidate will be advised of this when contacted for an interview and it will be the candidate’s choice to proceed with an interview or not.

Unsolicited resumes will be kept for three months and then destroyed. Resumes in response to specific openings will be kept for one year from when the opening is closed and then destroyed.

MIGENIX Inc. will only contact referees the candidate provides. However, if MIGENIX Inc. wants to contact referees not provided by the candidate, the Company will request consent from the applicant and will not proceed with the additional reference check until the applicant’s consent is provided. Reference checks will be destroyed after one year.

WILL WE SHARE YOUR PERSONAL INFORMATION WITH OUTSIDE PARTIES?
We will not sell individual information and will disclose it outside our organization only to our advisors for the purposes described above. Before you submit any information, we will notify you as to why we are asking for specific information and it is completely up to you whether or not you want to provide it.

As a resource to users, www.migenix.com may contain links to other sites that offer useful information. The privacy guidelines and procedures described here do not necessarily apply to those sites. For information on the privacy policies of individual sites, please contact those sites directly. MIGENIX does not assume responsibility for the content of those sites.

DO WE GIVE YOU ACCESS TO YOUR INFORMATION?

We take reasonable steps to maintain the security of your data on migenix.com. You should understand that the open nature of the Internet is such that data may flow over networks without security measures and may be accessed and used by people other than those for whom the data is intended.
